By accessing and using this Site, you accept and agree to be bound by these Terms of Use (“Terms”). (IV) trade secrets, know-how and other confidential information; and

(V) all other intellectual property rights, in each case whether registered or unregistered and including all applications and rights to apply for and be granted, renewals or extensions of, such rights, and all similar or equivalent rights or forms of protection in any part of the world.

“Products” means all products created, marketed, provided and/or sold by Ametos Tech, including but not limited to hardware, software, online or offline applications, and application plug-ins running on any platform or device.

“Services” means all professional services created, marketed, provided and/or sold by Ametos Tech, including but not limited to product support, vulnerability analysis, security consultation, incident response, penetration testing, and consulting services.

“Site” means all content, including the Materials, included on this website.

“Terms” means these Terms of Use.

5. LIMITED LICENSE

Ametos Tech grants you a limited, non-exclusive, non-sublicensable, non-transferable license to access and use in the United States the Site and the Materials on this Site for your personal, noncommercial use only.

The license is also subject to the following restrictions: you may not:

(I) modify the Materials or other contents of this Site or use them for any commercial purpose;

(II) decompile, reverse engineer, or disassemble Materials except and only to the extent required to be permitted by applicable law;

(III) remove any copyright or other proprietary notices from the Materials; or

(IV) use the Materials or other contents of this Site in a manner inconsistent with the scope of the license granted in these Terms or in any other way that is inconsistent with these Terms.

If you have a pre-existing business relationship with Ametos Tech, you may download, print or otherwise use the Materials for use in the furtherance of, and subject to the terms and conditions of, the provisions of your separate written agreement with Ametos Tech.

Any comments, information or other materials posted to this Site or transmitted to Ametos Tech such as questions, comments, suggestions, or the like regarding Ametos Tech Products or Services, this Site and the Materials will be considered non-confidential and non-proprietary unless expressly agreed otherwise in writing by Ametos Tech prior to your submission.

7. DISCLAIMERS AND LIMITATION ON LIABILITY

This Site is controlled by Ametos Tech and is intended for operation within the USA. Ametos Tech makes no representation that its Products and/or Services offered by the Site are appropriate or available for use in other locations, and access to them from territories where their content is illegal is prohibited. Those who choose to access this Site from other locations do so under their own initiative and are responsible for compliance with applicable local laws. Not all Products or Services mentioned may be available in your country. Please contact us or your local sales representative for information as to Products and Services available in your country.

AMETOS TECH PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL CONDITIONS, REPRESENTATIONS AND WARRANTIES NOT EXPRESSLY SET OUT IN THESE TERMS TO THE FULLEST EXTENT PERMITTED BY LAW.

AMETOS TECH SHALL HAVE NO LIABILITY FOR ANY LACK OF FUNCTIONALITY OR FAILURE TO PROVIDE ANY PART OF THE PRODUCTS OR SERVICES, OR ANY LOSS OF CONTENT OR DATA THAT IS DUE TO YOUR EQUIPMENT, DEVICES, OPERATING SYSTEM OR INTERNET CONNECTION, OR YOUR FAILURE TO COMPLY WITH SPECIFIED COMPATIBILITY REQUIREMENTS.

AMETOS TECH SHALL HAVE NO LIABILITY FOR DELAY OR FAILURE IN PERFORMANCE FOR CAUSES BEYOND OUR CONTROL OR ANY OTHER DAMAGE WHICH DOES NOT RESULT FROM A BREACH OF OUR OBLIGATIONS UNDER THESE TERMS.

WE SHALL NOT BE LIABLE TO YOU FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS AND PROPERTY DAMAGE, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, NOR SHALL WE BE HELD LIABLE FOR DELAY OR FAILURE IN PERFORMANCE RESULTING FROM CAUSES BEYOND OUR REASONABLE CONTROL.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION EXCEED ONE THOUSAND U.S. DOLLARS (US $1,000).

Upon such termination, you agree to immediately destroy any Materials in your possession or control.

10. GOVERNING LAW

These Terms, including any claim arising out of these Terms, shall be governed by the laws of the State of Delaware in the USA and any proceedings arising out or in connection with this Site shall be subject to the exclusive jurisdiction of the competent courts of the State of Delaware in the USA.

11. MODIFICATIONS OF THESE TERMS

Ametos Tech reserves the right to modify these Terms at any time without notice by altering or updating this posting, and such modifications shall be effective immediately upon posting of the modified Terms. Your continued use of the Site shall be deemed as acceptance of the modified Terms.
